Terms and Conditions

1. Interpretation and Definition
In these Terms and Conditions the following words and phrases shall have the following meanings:
     · The "Carrier" means Royal Mail, Parcelforce or any other provider of delivery services chosen by the Company to provide delivery services to Customers.
     · The "Company" means Mark An Occasion with Scotland Direct
     · The "Customer" means a person who has placed an Order with the Company.
     · "Order" means an order made in accordance with these Terms and Conditions on an Order Form or by other written or electronic means containing similar information to an Order Form, or by telephone and in each case accompanied by full payment including, where applicable, payment for postage and packing, and for transit insurance.
     · "Order Form" means a pre-printed order form issued by the Company or copy of such a form.

2. Receipt Of Orders
The placing of an Order by a Customer shall constitute an offer to the Company to purchase goods at the current price advertised by the Company. The Company shall have an absolute discretion as to whether or not to accept that offer.

3. Offer and Acceptance
If the Company decides not to accept an offer made according to the terms of Clause 2. above, it shall inform the Customer accordingly and refund or return to the Customer all monies included with the Order, or those sums relating to that part of the Order which is not accepted.

4. Availability of Stock
The Company shall endeavour to supply any and all items ordered. However, the Company reserves the right not to supply any or all items ordered by a Customer if the same are not available.

5. Delivery
Our obligation is to deliver the products at the delivery address you have specified in your order to a person who appears to be over the age of 18 and who appears to be authorised to take delivery. Delivery is not available on public holidays. We may deliver the products at any time during the day.

For insurance purposes, our carrier requires a signature for delivery, except where clear alternative instructions have been given by the customer. If you are not normally at home in working hours, please give an alternative address to which your delivery can be made such as your place of work or a neighbour. A telephone contact number for use by the delivery operator would be helpful. In the event of the driver leaving a card while you are out, please telephone the number on the card - the same day if possible.

The Company shall endeavour to ensure that a Customer's Order is despatched at the time requested by that Customer. Where the Company is unable to despatch an order at the time requested by a Customer, that order shall be despatched as close to the time requested as is reasonably possible, whether this is earlier or later than the time requested.

For Internet orders within the UK, your purchase will arrive within 5 working days. If for any reason the item you have ordered is not in stock, we will e-mail or telephone you to let you know when you can expect to receive your purchase.

NB - The above rates for overseas deliveries are for single bottles.  Customer services will contact you with details of any additional costs for the shipment of multiple bottles.

Overseas Customers Please Note -
We deal with each Overseas delivery on an order by order basis, this is due to the variances of countries Customs & Tax laws.

Customers from North America please note -
We are able to ship items to the U.S.A. and Canada, but unfortunately due to customs restrictions we can not offer a guaranteed delivery, as we are unable to insure our packages against loss, theft or damage. Whilst in practice many items will arrive at their destination intact, our standard guarantee will not be applicable to packages destined for these countries.

Please contact us directly for delivery charges to your specific location; any additional Custom’s charges due on overseas deliveries are the sole responsibility of the individual customer

6. Title and Risk
Title to and risk in the items ordered by the Customer shall pass to the Customer on delivery to the Customer(s) premises once full payment has been received by the company.

7. Guarantees and limitation of liability
     7.1. If a Customer is not satisfied with any item supplied to him by the Company, he or she may return that item to the Company for a replacement or refund.
     7.2. The Company's liability for any and all purposes including loss consequential to a breach of these Terms and Conditions or if any item supplied is in any way unsatisfactory shall be limited to a maximum of the value paid by the Customer to the Company

8. Repayments due to Customers
Where the Company is liable to repay any amount to a Customer under these Terms and Conditions, that repayment shall take the form of a cheque or card refund for all sums.

9. Cancellation and Variation of Orders
A Customer may at any time before the day on which the Order is packed, amend or cancel the Order, including changes to the preferred despatch or collection dates, without incurring any extra charge

10. Catalogue Prices
     10.1. Unless otherwise stated, all prices shown in catalogues and price lists include any VAT, which is chargeable on the sale of the particular item.
     10.2. In the event that VAT rates increase during the currency of a catalogue or price list, the Company reserves the right to pass on any such additional amounts to the Customer.
     10.3. Catalogue prices for items for delivery to countries outside the European Union are exclusive of VAT, which is currently charged at 17.5% in the UK. These prices are not shown in any catalogues delivered to such countries.

11. Terms and Conditions
     11.1. These Terms and Conditions shall override all other contractual terms other than those implied under sections 12 and 14 of the Sale of Goods Act 1979.
     11.2. The Company may at any time amend or replace these Terms and Conditions. Any other Terms and Conditions introduced will not apply to any Orders placed during the currency of these Terms and Conditions

     12.2 Mark An Occasion accepts no liability arising from errors (including typographical) contained in, or any omissions from, this website. We will endeavour to make this site available at all times but cannot guarantee that it will operate without any interruptions.
